Comments on the instrument:
The draft law contains most of the rights and obligations enshrined in the Model Law, but in a short and undetailed way that could allow for restrictive interpretation or application. There is no explicit reference to the right to freedom from defamation and stigmatisation. Articles 2-4 allow for a broad interpretation of the law: Article 2 states that the law aims to affirm Benin’s commitment to the effective implementation of the UN human rights defender Declaration and other relevant instruments for the protection of human rights defenders. Articles 3 and 4 establish that the law shall be interpreted and applied in a way that is consistent with the rights and freedoms recognised in international instruments and commitments adopted by Benin.
